(i)             What do you mean by noxious food and drinks? Describe the side effects of noxious food?

ANSWER:   noxious foods and drinks means unhealthy food and drinks or adulteration of foods and drinks.

 According to MERRIAM-WEBSTER Dictionary noxious means:  physically harmful or destructive to    living beings.

Now I am explaining in detail about adulteration of foods and drinks and their side effects:

Food is the basic necessity of life. It should be pure, nutritious, and free from any type of adulteration for proper maintenance of human health. One works hard and earns to satisfy one’s hunger. But at the end of the day, we are not sure of what we are eating. We might be eating a dangerous dye, sawdust, industrial starch, or other contaminated foods which are a major source of diseases. And thus, we invite diseases rather than good health. Food adulteration is basically lowering the quality of food for sale either by the admixture or by the substitution of inferior substances or by the removal of some valuable nutritious ingredient.

Few days ago, I was watching news channel and I horrified to see the adulteration going on in our country just for a few bugs. People do not bother for others lives and health. Since every consumer wants to get maximum quantity of a commodity at lower prices, the traders make use of this fact and quality of the product lowers through the addition of toxic or harmful substances or removal of the nutritional one. Thus, we ourselves create situations for the traders to make our health unfit. Such type of food is extremely dangerous as it may be toxic and can affect health and it may deprive nutrients essential for proper growth and development. What I saw was actually shocking, cucumber was injected with the oxytocin given to pregnant ladies during their pains, just to increase its size. Taking that may lead to heart problem, high blood pressures and could even lead to death. Similarly, banana was treated with ethril containing ethylene that could lead to loss of memory or blindness. There are many more food items, even no fruit or vegetable has remained untouched of the adulteration. Some of the common adulterated foods are Milk and Milk products, Floor, Oils, Cereals, Pulses, Tea, Coffee and Vinegar. The consequences of taking adulterated foods could be more than very dangerous, it could lead to Paralysis, anemia, Vomiting, diarrhea, Liver damage, cancer etc.

 

 

 

 

(ii)           What remedy you can avail under criminal law against the offences   affecting the public health and safety?

The following remedies we can avail under criminal law against  the offences affecting the public health and safety.

 

According to provisions of section no: 272 (Adulteration of food or drink intended for sale) of PPC:

Whoever adulterates any article of food or drink, so as to make such article noxious as food or drink, intending to sell such article as food or drink, or knowing it to be likely that the same will be sold as food or drink, snail be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.

 

 

 

According to provisions of section no: 273 (Sale of noxious food or drink) OF PPC:

 Whoever sells, or offers or exposes for sale, as food or drink, any article which has been rendered or has become noxious, or is in a state unfit for food or drink, knowing or haying reason to believe that the same is noxious as food or drink, shall be punished with imprisonment of either description for a term which may extend to six months, of with fine which may extend to one thousand rupees, or with both.

 

According to provisions of section no: 274 (Adulteration of drugs) of PPC:

 Whoever adulterates any drug or medical preparation-in such a manner as to lessen the efficacy or change the operation of such drug) or medical preparation, or to make it noxious intending that it shall be sold or used for, or knowing it to be likely that it will be sold or used for, any medicinal purposes, as if it had not undergone such adulteration, shall be punished with imprisonment of either description for a term which may extend to six months or with fine which may extend to one thousand rupees, or with both.

 

 

According to provisions of section no: 275 (Sale of adulterated drugs) of PPC:

Whoever, knowing any drug or medical preparation to have been adulterated in such a manner as to lessen its efficacy, to change its operation, or to render it noxious, sells the same, or offers or exposes it for sale, or issues it from any dispensary for medicinal purposes as unadulterated, or causes it to be used for medicinal purposes by any person not knowing of the adulteration, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.

 

According to provisions of section no: 276 (Sale of drug as a different drug or preparation):

Whoever knowingly sells, or offers or exposes for sale, or issues from a dispensary for medicinal purposes, any drug or medical preparation, as a different drug or medical preparation, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both,
